Terms of Service
These Terms of Service (“Terms”) form a binding agreement between you and Alaska Boat And Fishing Academy LLC, doing business as Alaska Bait Express (“Alaska Bait Express,” “we,” “us,” or “our”), governing your access to and use of the Alaska Bait Express mobile application (the “App”), the website at alaskabait.com (the “Site”), and any related services we provide (together, the “Services”).
By creating an account, placing an order, or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years of age and capable of entering a legally binding contract to use the Services. By using the Services you represent that you meet these requirements. The Services are intended for users located in the United States.
2. Your Account
You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us immediately at info@alaskabait.com if you suspect unauthorized use. You agree to provide accurate, current, and complete information when registering and to keep that information up to date.
You may have only one active account. We may suspend or terminate accounts that contain false information, are duplicates, or are used in violation of these Terms.
3. The Services
The Services allow you to:
- Browse a catalog of bait, tackle, and related fishing supplies;
- Place orders for local delivery within our service area;
- Pay for orders by credit or debit card through Stripe, or by other payment methods we may make available;
- Track the status of your deliveries; and
- Receive transactional and (with your consent) promotional messages.
Inventory, pricing, product descriptions, and service area are subject to change at any time without notice. We do not guarantee that any particular product will be available at any particular time.
4. Orders, Pricing, and Payment
4.1 Orders
When you place an order, you are making an offer to purchase the listed items at the price displayed at checkout. We accept the offer when we charge your payment method and confirm the order in the App. We reserve the right to refuse, limit, or cancel any order — including for suspected fraud, pricing errors, stock shortages, or service-area restrictions — at our discretion. If we cancel an order before delivery, we will refund any amount charged.
4.2 Pricing
Prices shown in the App are in U.S. dollars and reflect the price at the moment you complete checkout. Alaska has no statewide sales tax, but local borough or municipal taxes may apply and, if so, will be itemized on your receipt.
4.3 Payment
Card payments are processed by Stripe, Inc. Alaska Bait Express does not directly receive or store your full card details. Your use of card payments is also subject to Stripe’s terms and policies.
If a payment is declined, reversed, charged back, or otherwise fails, we may suspend or cancel your order, suspend your account, and recover any amounts owed (including reasonable collection costs) through any lawful means.
5. Delivery
5.1 Service area
Delivery is currently available within the Homer, Alaska area and may expand or change over time. Deliveries are made to marinas, residences, and other locations within the service area at delivery windows scheduled in the App.
5.2 Scheduling and presence
You must be present (or arrange for an authorized person to be present) at the delivery location during your scheduled time window. If our driver cannot complete the delivery because you are not present, the location is inaccessible, or contact information is incorrect, we may, at our discretion, leave the order, reschedule for an additional fee, return the order to inventory, or cancel the order. Perishable items left unattended at your direction are at your own risk.
5.3 Weather, safety, and operational delays
We may delay, reschedule, or cancel deliveries due to weather, sea conditions, road conditions, vehicle or vessel issues, supplier shortages, or other events outside our reasonable control. If we cancel an order for any of these reasons, we will issue a full refund. We are not liable for indirect or consequential losses caused by delivery delays.
5.4 Perishable goods
Bait and certain other products are perishable. Once delivered, perishables are your responsibility. Quality concerns about a perishable item must be reported to info@alaskabait.com within 24 hours of delivery, with photographs if possible, so we can investigate.
6. Cancellations, Refunds, and Returns
6.1 Customer cancellations
You may cancel an unpicked order from the App at any time before our driver has picked the order from our warehouse. Cancellations made before pick are refunded in full to the original payment method.
Once an order has been picked or is in transit, cancellation is no longer self-serve. Contact us at info@alaskabait.com and we will work with you to resolve the situation, which may include a partial refund, replacement, or return-to-stock.
6.2 Short or substituted items
If we are unable to fulfill the full quantity of any item, we will mark the order as “short,” contact you, and refund the unfilled portion to your original payment method. We do not substitute items without your consent.
6.3 Quality issues
If a delivered item is materially defective or not as described, contact us within 24 hours of delivery at info@alaskabait.com. Remedies, at our discretion, may include a refund, replacement on a future delivery, or store credit.
6.4 No returns of perishable items
For health and safety reasons, perishable items, once accepted at delivery, are not returnable.
6.5 Refunds
Approved refunds are issued to the original payment method. Card refunds typically post within 5–10 business days, subject to your card issuer’s processing time.
7. SMS Communications
If you provide a phone number, you may receive transactional SMS messages from Alaska Bait Express about your account, orders, and deliveries. Standard message and data rates may apply. Message frequency varies based on your order activity.
If you separately opt in to marketing or broadcast SMS, you can opt out at any time by replying STOP to any marketing message; reply HELP for help. Consent to marketing SMS is not a condition of any purchase. See our Privacy Policy for additional details on SMS communications.
8. Fishing Licenses, Regulations, and Personal Responsibility
You are solely responsible for ensuring that your use of any product purchased through the Services complies with all applicable laws and regulations, including Alaska Department of Fish and Game licensing, season, bag, possession, and gear regulations. We do not verify your eligibility to fish or use any product, and we make no representation that any product is suitable for any particular intended use, water body, or species.
9. Acceptable Use
You agree not to:
- Use the Services in violation of any law or regulation;
- Use the Services to harass, threaten, or defraud any person;
- Use the Services for resale or commercial redistribution without our prior written consent;
- Attempt to access accounts or data that are not yours;
- Interfere with, disrupt, reverse-engineer, scrape, or probe the Services;
- Upload content that is unlawful, infringing, defamatory, obscene, or otherwise objectionable; or
- Misrepresent your identity or affiliation.
We may suspend or terminate access for any violation of these Terms.
10. Intellectual Property
The Services, including the App, the Site, and all text, graphics, logos, images, software, and other content (other than User Content as defined below), are owned by Alaska Bait Express or our licensors and are protected by U.S. and international intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended personal, non-commercial purpose. All rights not expressly granted are reserved.
11. User Content
Any content you submit through the Services — feedback, photos, messages, or otherwise (“User Content”) — remains yours. You grant Alaska Bait Express a worldwide, royalty-free, non-exclusive license to use, reproduce, store, and display that content solely for the purpose of operating and improving the Services. You represent that you have all rights necessary to grant this license and that your User Content does not violate any law or the rights of any third party.
12. Third-Party Services
The Services rely on third-party platforms (including Firebase, Stripe, Twilio, and others). Your use of those platforms is also subject to their respective terms. We are not responsible for the acts or omissions of third-party platforms, except to the limited extent required by law.
13. Disclaimers
The services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or any warranty arising from a course of dealing or usage of trade. We do not warrant that the services will be uninterrupted, error-free, or secure, or that any product will produce any particular fishing result.
Some jurisdictions do not allow the disclaimer of certain implied warranties, so portions of this section may not apply to you.
14. Limitation of Liability
To the fullest extent permitted by law, in no event will Alaska Bait Express, its officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or in connection with these Terms or the Services, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not we have been advised of the possibility of such damages.
Our total cumulative liability arising out of or related to these Terms or the Services will not exceed the greater of (a) the amounts you paid us in the six months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so portions of this section may not apply to you.
15. Indemnification
You agree to defend, indemnify, and hold harmless Alaska Bait Express and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party; or (d) your User Content.
16. Termination
You may stop using the Services and delete your account at any time. We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or if termination is necessary to protect the Services or other users. Sections that by their nature should survive termination (including Sections 10, 13, 14, 15, 17, and 18) will survive.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Alaska, without regard to its conflict-of-laws principles.
Before filing any claim against us, you agree to first contact us at info@alaskabait.com with a written description of the dispute and to negotiate in good faith for at least 30 days. If we cannot resolve the dispute informally, any action arising out of or related to these Terms or the Services must be brought exclusively in the state or federal courts located in the State of Alaska, and you consent to the personal jurisdiction and venue of those courts.
You and Alaska Bait Express each waive any right to a jury trial. Either party may bring qualifying claims in small-claims court.
18. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you in the App or by email. Your continued use of the Services after a change becomes effective constitutes acceptance of the updated Terms.
19. Miscellaneous
These Terms, together with our Privacy Policy, are the entire agreement between you and Alaska Bait Express regarding the Services. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign them freely.
